-fhall incur the faid penalty, if he fhall make oath or affirmation that he had no knowledge of or information concerning the regulation herein contained, unlefs it can be otherwife proved that he had fuch knowledge or information.

Sec. 5. And be it further enacted, That all be appoin- officers and perfons to be appointed pursuant auce of this to this act, before they enter upon the duties act to take of their refpective offices, fhall feverally take an oath diligently and faithfully to execute the duties of their faid offices refpectively, and to use their beft endeavors to prevent and detect frauds in relation to the duties impofed by the laws of the United States; which oath, if taken by a collector, may be taken before any magiftrate authorized to administer oaths within the district to which he belongs; but if taken by another, fhall be taken before the collector of his diftrict, and being certified under the hand and feal of the perfon by whom the fame fhall have been adminiftered, fhall, within three months thereafter be tranfmitted to the comptroller of the treafury; in default of taking which oath, the party failing fhall forfeit and pay two hundred dollars, to be recovered with cofts of fuit, in any court of competent jurifdiction, to the ufe of the United States.

Sec. 6. And be it further enacted, That the the collec- feveral officers of the cuftoms fhall refpectively perform the duties following; to wit: At fuch of the ports to which there fhall be appointed a collector, naval-officer and furveyor, the collector fhall receive all reports, manifefts and documents, to be made or exhibited on the entry of any fhip or veffel, according to

the regulations of this act; fhall record in books to be kept for that purpose, all fuch manifefts; fhall receive the entries of all fhips and veffels, and of the goods, wares and merchandize imported in them; fhall, together with the naval-officer, where there is one, or alone where there is none, eftimate the amount of the duties payable thereupon, endorfing the faid amount upon the respective entries; fhall receive all monies paid for duties, and take all bonds for fecuring the payment thereof; fhall grant all permits for the unlading and delivery of goods; fhall employ proper perfons as weighers, guagers, measurers and inspectors at the feveral ports within his district; and shall provide at the public expence, and with the approbation of the principal officer of the treafury department, ftore-houses for the fafe-keeping of goods, and fuch fcales, weights and measures as may be neceffary. The, naval-of- aval of ficers fhall receive copies of all manifefts; shall together with the collector, eftimate the duties on all goods, wares and merchandize fubject to duty, keeping a feparate record thereof; and shall counterfign all permits, clearances, certificates and debentures to be granted by the collector. The furveyor fhall fuperintend and direct all inspectors, weighers, measurers furveyorą and guagers within his diftrict; fhall vifit and infpect the fhips or veffels which arrive within his diftrict, and fhall have power to put on board each of them one or more infpectors; fhall ascertain the proofs of diftilled fpirits, rating those which fhall be of the proof of twenty-four degrees as of Jamaica proof; and fhall examine whether the goods imported in any fhip or veffel, and the deliveries thereof, are conformable to the entries of fuch goods VOL. figned, the faid collector fhall folely execute all the duties in which the co-operation of the naval-officer is requifite at the ports where a naval-officer fhall be appointed, which he shall alfo do in cafe of the difability or death of the naval-officer. And at the ports to which a collector only is affigned, fuch collector fhall folely execute all the duties in which the cooperation of the naval-officer is requifite as aforefaid and fhall alfo, as far as may be, perform all the duties prescribed to furveyors at the ports where fuch officers are established. And at ports to which furveyors only are af figned, every fuch furveyor fhall perform all the duties herein before enjoined upon furveyand fhall alfo receive and record the copies of all manifefts which shall be tranfmitted to him by the collector; fhall record all permits granted by fuch collector, diftinguishing the guage, weight, meafure and quality of the goods fpecified therein; and fhall take care that no goods be unladen or delivered from any ship or veffel without a proper permit for that purpose. Sec. 9. And be it further enacted, That from veffels from and after the first day of October next, no goods, wares or merchandize fhall be brought into the United States from any foreign port their cargo. or place, in any fhip or veffel belonging in the whole or in part to a citizen or citizens, inhabitant or inhabitants of the United States, unlefs the mafter or perfon having the charge or command of fuch fhip or 'veffel fhall have on board a manifest or manifefts in writing, figned by fuch mafter or other person, containing the name or names of the port or ports, place or places where the goods in fuch manifeft or manifefts mentioned, fhall have been refpectively taken on board, and the port or ports, place or places within the United States for which the fame are refpectively configned or deftined, and the name and built of fuch fhip or veffel, and the true admeasurement or tonnage thereof according to the register of the fame, together with the name of the mafter or other perfon having the command or charge
